Die Reedition der von den Verfassern nunmehr Excerpta Vaticana et Laurentiana genannt wird, findet ihre Begründung darin, dass der Erstherausgeber, der berühmt Rechtshistoriker Contardo Ferrini offenbar auf eine Kollationierung beider Codices verzichtet hat und im Übrigen, aus welchen Gründen auch immer, bei der Edition selbst nicht unwesentliche Versehen verschuldet hat. Der Codex Vaticanus Palatinus ist wohl in der ersten Hälfte des 14. Jahrhunderts entstanden, der Codex Laurentianus 80.6 in der ersten Hälfte des 15. Jahrhunderts. Grundsätzlich sind die Verfasser der Meinung, (...) die mit zahlreichen plausiblen Argumenten vorgetragen wird, dass der Schreiber des Codex Laurentianus 80.6, ein gewisser Stephanus of Medea, als Vorlage den heutigen Codex Vaticanus Gr. 19 vor sich liegen hatte, und als intelligenter Kopist verschiedene Emendationen vorgenommen hat. Eine große Mehrheit der Fragmente der Excerpta Vaticana et Laurentiana von 1–193 muss einem Juristen Anatolius zugeschrieben werden. Jene Person, die sie zusammengestellt hat, muss ein altes Manuskript mit der Summa Codicis des Anatolius verwendet haben. In dieser Summa waren die Termini technici immer noch in lateinischer Sprache verfasst. Zur Selektion der Texte führen die Verfasser an, dass überdurchschnittlich großes Interesse dem Strafrecht und dem Familienrecht gewidmet ist, während etwa Eigentumserwerb, Erbrecht und große Teile des Obligationenrechtes kaum Behandlung finden. Die Exzerpierung der Summa Codicis muss aus diesem Grunde von jemand vorgenommen worden sein, der eine besondere Affinität gerade zu diesen Bereichen des Rechtes hatte. Nach diesen grundsätzlichen und grundlegenden Ausführungen, die ich allesamt nicht nur begrüße, sondern voll mittragen möchte, widmen sich die Verfasser kurz aber prägnant der Person des Anatolius (24–30). Ein Anatolius wird zusammen mit sieben anderen Antecessores in der Constitutio Omne genannt, sowie in der Constitutio Tanta vom 16. Dezember 533 als einer der vier Professoren, denen die Kompilation der Digesten anvertraut worden war. Er bekleidete die Funktion eines Magister Officiorum und wurde aus diesem Grunde als Vir Illustris bezeichnet. Anatolius entstammte einer Juristenfamilie aus Beirut und lehrte dort selbst als Professor. Zachariae von Lingenthal (Griechische Bearbeitung des Codex 70) und Van der Waal (Comentar 111) hatten die Ansicht vertreten, dass es zwei Anatoli gegeben habe: Der eine Mitglied der justinianischen Kompilation, der andere der Autor des Codex-Kommentares. Dem gegenüber vertreten die Autoren die Ansicht, dass Anatolius ein einziger gewesen sei, der, nachdem er maßgeblich an der Kompilation in Konstantinopel mitgearbeitet hatte, etwa zwischen 530 und 533 als Lehrer nach Beirut zurückgekehrt sei, um dort an einer der prestigeträchtigsten Universitäten des Reiches die neue juristische Studienordnung durchzusetzen und ruhmreich zu begründen. Der Kommentar des Codex diente dazu, einen grundsätzlichen lateinischen Text griechischen Studenten zu verdeutlichen, und zwar ausgehend von einer reinen Übersetzung bis zu einem juristischen Kommentar. Die Autoren lösen die Quellenproblematik derart, dass sie davon ausgehen, dass Anatolius das Buch 4 seines Kommentares noch in Konstantinopel vollendet und mit dem 8. Buch des Kommentares in Beirut wieder begonnen hat. Die klare und deutliche Argumentationsweise der Autoren, unpolemisch aber doch tiefgreifend, sollte in Zukunft übernommen werden. (shrink)

AimThe neurocognitive basis of Developmental Coordination Disorder remains an issue of continued debate. This combined systematic review and meta-analysis provides a synthesis of recent experimental studies on the motor control, cognitive, and neural underpinnings of DCD.MethodsThe review included all published work conducted since September 2016 and up to April 2021. One-hundred papers with a DCD-Control comparison were included, with 1,374 effect sizes entered into a multi-level meta-analysis.ResultsThe most profound deficits were shown in: voluntary gaze control during movement; cognitive-motor integration; practice-/context-dependent (...) motor learning; internal modeling; more variable movement kinematics/kinetics; larger safety margins when locomoting, and atypical neural structure and function across sensori-motor and prefrontal regions.InterpretationTaken together, these results on DCD suggest fundamental deficits in visual-motor mapping and cognitive-motor integration, and abnormal maturation of motor networks, but also areas of pragmatic compensation for motor control deficits. This paper explores the development of mathematics on a quantum logical base when mathematical postulates are taken as necessary truths. First it is shown that first-order Peano arithmetic formulated with quantum logic has the same theorems as classical first-order Peano arithmetic. Distribution for first-order arithmetical formulas is a theorem not of quantum logic but rather of arithmetic. Second, it is shown that distribution fails for second-order Peano arithmetic without extensionality. Third, it is shown that distribution holds for second-order Peano arithmetic (...) Anselm's argument has two distinct conclusions: (a) we cannot intelligibly doubt that god exists, and (b) this god, whose existence we cannot doubt, exists necessarily. if we replace anselm's vague conception of god by the spinozistic conception of substance, a defensible version of the ontological argument, understood as having these two conclusions, can be constructed. two important consequences of this analysis are: (1) the ontological argument, properly understood, deals simply with the concept of substance. it is a further question whether (...) substance ought to be understood as god. (2) the ontological argument does not actually demonstrate the existence of anything. it simply makes clear the consequences of adopting a metaphysical view which employs the spinozistic conception of substance. Negative people/wildlife interaction has raised public interest in wildlife population control. We present a contingent valuation study of alternative deer control measures considered for Hilton Head Island, SC. Lethal control usig sharpshooters and nonlethal immuno-contraception techniques are evaluated. A mail-back survey was used to collect resident willingness-to-pay information for reduced deer densities and consequent property damage. Residents are unwilling to spend more for the nonlethal alternative. The estimated WTP appears theoretically consistent as increasing levels of abatement for both lethal and (...) nonlethal alternatives demonstrate diminishing marginal benefits. Over 60% of respondents bid zero regardless of control measure, suggesting a referendum would fail. However, only half of these zero bidders expressed no problem with deer, while the other half bid zero because of distaste for the control alternative, safety concerns, or doubt about effectiveness. Inclusion of these responses as legitimate zero bids depressed mean WTP estimates from 22 to 31%. (shrink)

The present volume contains the lectures and papers given at the 1994 international conference on hermeneutics in Halle (Germany). The conference aimed at a state of the art in the light of recent developments in science and humanities. The place in which the conference was held is renowned for its centuries-old tradition in hermeneutics and among the lectures there are indeed some devoted to this history. For the most part, however, the papers concentrate on present-day problems in fields as different (...) as comparative literature, religious studies, bible exegesis, esthetics, social sciences, intercultural dialogue. The theme of the conference, "strangeness and familiarity", reflects the tension in which any interpretation process is situated and that any theory of interpretation has to account for. _The Scarlet Empire_ (1906) by David Maclean Parry, a former president of the National Association of Manufacturers (NAM), offers an anti-utopian romance set in an authoritarian socialist Atlantis. Supplementing the efforts of NAM to limit the power of unions and diminish the appeal of socialism through political and editorial suasion, the novel promised a new and powerful way of proselytizing middle-class readers by competing with prominent literary utopians and socialists, especially Edward Bellamy and Upton Sinclair. The novel's protagonist is converted (...) to individualism and capitalism and comes to see socialism as emasculating. _Empire_ bundles capitalism and masculinity together through a redemptive adventure romance narrative that serves capitalist ideological purposes and has the protagonist combining tremendous wealth, a powerful faith in individualism, and a recovered masculine subjectivity to become a captain of industry and paragon of a hegemonic masculinity at the turn of the twentieth century. In this transcription of the lectures that formed the initial version of Hegel's text, the philosopher presents his thought with a clarity and directness seldom matched in his later writings. Nowhere does Hegel make clearer the difference between his concept of objective spirit and traditional concepts of natural law. (...) Nowhere does he offer a more prominent treatment of the key notion of recognition. These lectures constitute the earliest version of Hegel's Philosophy of Right, one of the most influential works in Western political theory. They introduce a notion of civil society that has proven of inestimable importance to diverse philosophical and social agendas. This transcription of the lectures, which remained in obscurity until 1982, presents the philosopher's social thought with clarity and boldness. It differs in some significant respects from Hegel's own published version of 1821. Nowhere does Hegel make plainer the difference between (...) his concept of objective spirit and traditional concepts of natural law or offer a more prominent treatment of the key notion of recognition. His description of poverty is more forceful and his critique of existing social conditions more thorough than in the published edition, which had to satisfy the Prussian censor. The strictly limited powers of the monarch are more clearly delineated in the Heidelberg lectures, and the arguments for a bicameral legislature are more explicit. Hegel formulates in a more dynamic way his understanding of the relationship between rationality and actuality--the rational is not what exists but what is coming into being--and sets forth more simply and clearly the central themes of his political philosophy--freedom, justice, and community. The Heidelberg lectures are an indispensable resource for understanding the edition of 1821 and an invaluable supplement to one of the great classics of political philosophy. (shrink)

In studying Plato’s Crito with a primary concern for Plato's friend Crito, this book reveals the rarity of the philosopher, the tension between the citizen’s natural understanding of justice and the city’s necessary understanding of justice, and how one might attempt to ease this tension.

A commonly held view is that a central aim of metaphysics is to give a fundamental account of reality which refers only to the fundamental entities. But a puzzle arises. It is at least a working hypothesis for those pursuing the aim that, first, there must be fundamental entities. But, second, it also seems possible that the world has no foundation, with each entity depending on others. These two claims are inconsistent with the widely held third claim that the fundamental (...) just is the foundational. It is tempting to resolve the puzzle by rejecting the first or second claim, perhaps because it is obscure how the third claim might plausibly be challenged. But I develop a new analysis of fundamentality which challenges the third claim by allowing for an entity to be fundamental without being foundational. The analysis, roughly, is that an entity is fundamental just in case not all facts about it are grounded in facts about other entities. The possibility of fundamentality without foundations not only provides for a novel resolution to the puzzle, but has applications to some live debates: for example, it undermines Jonathan Schaffer's modal argument for priority monism. Saul Kripke’s work on the semantics of modal logics is well known, unlike his work on Anderson and Belnap’s system E of Entailment (a modal relevance logic), which included his proof of the decidability of its implicational fragment E_>, and also a counterexample to the conjecture of Belnap that E_> is the intersection of the implicational fragments of the relevance logic R and the modal logic S4. This led to Storrs McCall’s suggesting that the “mingle” axiom might be added to (...) E_>, and that this system might be used instead of S4_>. We give a counterexample to this conjecture. We also disprove the conjecture Anderson and Belnap attribute to McCall, in which “restricted mingle” is added to E_>. We use a modal extension of the lattice M_0 and follow ideas of Meyer. In the 1970s, Dunn showed that RM (R with the mingle axiom) can be modeled using a binary accessibility relation, like the accessibility relation in Kripke’s semantics for normal modal logics and his semantics for intuitionistic logic. Dunn also gave a variant interpretation for EM (E with the mingle axiom). We explore some other variations of these binary relational semantics. (shrink)

This paper explores allowing truth value assignments to be undetermined or "partial" and overdetermined or "inconsistent", thus returning to an investigation of the four-valued semantics that I initiated in the sixties. I examine some natural consequence relations and show how they are related to existing logics, including ukasiewicz's three-valued logic, Kleene's three-valued logic, Anderson and Belnap's relevant entailments, Priest's "Logic of Paradox", and the first-degree fragment of the Dunn-McCall system "R-mingle". None of these systems have nested implications, and I investigate (...) twelve natural extensions containing nested implications, all of which can be viewed as coming from natural variations on Kripke's semantics for intuitionistic logic. In this paper we discuss ethical implications of the use of mobile phone apps in the control of the COVID-19 pandemic. Contact tracing is a well-established feature of public health practice during infectious disease outbreaks and epidemics. However, the high proportion of pre-symptomatic transmission in COVID-19 means that standard contact tracing methods are too slow to stop the progression of infection through the population. To address this problem, many countries around the world have deployed or are developing mobile phone apps (...) capable of supporting instantaneous contact tracing. Informed by the on-going mapping of ‘proximity events’ these apps are intended both to inform public health policy and to provide alerts to individuals who have been in contact with a person with the infection. The proposed use of mobile phone data for ‘intelligent physical distancing’ in such contexts raises a number of important ethical questions. In our paper, we outline some ethical considerations that need to be addressed in any deployment of this kind of approach as part of a multidimensional public health response. We also, briefly, explore the implications for its use in future infectious disease outbreaks. (shrink)

Multiple concepts of nature are at play in environmental theory and practice. One that has gripped several theorists is the idea of nature as referring to that which is independent of humans and human activity. This concept has been subject to forceful criticism, notably in the recent work of Steven Vogel. After clarifying problematic and promising ways of charac­terizing independent nature, I engage Vogel’s critique. While the critique is compelling in certain respects, I argue that it fails to appreciate what (...) I take to be an important motivating concern of those drawn to the concept of independent nature, or something like it. I offer a characterization of that concern—a worry about problematic instrumentalization of the nonhuman world—and suggest why this concern, and the idea of independent nature which helps to make it intelligible, should continue to inform environmental theory and practice. In offering a qualified defense of the concept of independent nature, and of its value, I assume that such a concept is only one possible tool in a multi-pronged approach to environmental theorizing, deliberation, action, and policy.
